Terms and Conditions.
By booking with Love, Gem Photography you are agreeing to the below terms and conditions. Please read before booking with me, this seems very formal but it is to protect us both and ensure the best results from working together!
In the following terms and conditions "the photographer" shall mean Gemma of Love, Gem Photography. "The client(s)" shall be those persons defined as the person being photographed and/or booking the photo session. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed upon by the photographer in writing.
All digital files are copyrighted and are the property of Love, Gem Photography. The digital files are the client(s) property for personal use and the purpose of reproduction and distribution to friends and relatives.
Website display and promotional usage:
The client(s) hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc. Unless specifically asked not to in writing by the client and agreed upon by the photographer.
Upon paying your booking fee ($100NZD) Love, Gem Photography will reserve the date agreed upon, and will not make other reservations for this time and date. For this reason, the booking fee is non-refundable. The date is transferable only due to weather or sickness, at a maximum of two changes. If the client(s) simply decides to change their date to a new date another booking fee of $100 needs to be paid to secure a new date. The outstanding balance is due 5 working days before your photo shoot.
Cancellation of booking:
The client(s) understands that: where the client cancels a booking appointment, the client(s) is LIABLE and agrees to PAY a cancellation fee of $100, regardless of whether the appointment is attended or not. The money paid to the photographer towards the booking/appointment can be applied towards another session to the value of the amount paid, at the photographer's discretion.
The photographer's shooting schedule, style of working, and experience is designed to achieve a great experience and set of memorable photos for the client(s). Both the client(s) and the photographer therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the client(s) does not run on time (for example extreme lateness of the client) the photographer cannot guarantee to take the normal set of photos although the photographer will do the absolute best to compensate. The client(s) agree to assist and cooperate with the photographer in obtaining the desired photographs as best they can. The photographer should not be responsible for photographs not taken as a result of your failure to provide reasonable assistance or cooperation.
Force Majeure or act of God:
In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid. If the weather isn't suitable this will be decided by the photographer and a suitable new date will be arranged. No booking fees will be refunded in this instance as weather conditions are out of the photographer's control. If due to Covid restrictions the photoshoot can't be completed a new suitable date will be arranged.
The photographer shall be granted artistic license in relation to the poses photographed, the location used and digital retouching. The photographer's judgment regarding the locations, poses, editing, and number of photographs taken shall be deemed to be correct.
The photographer will retain your photographs for a period of time of one month, yet it is the client(s) responsibility to back up the photos onto additional USB's/computers/hard drives.
The photographer respects the client(s) privacy and personal information is not shared with any third party or other organisations.
